Iam on H1B visa. My first H1B(after converting from F1) is untill Dec 14th 2003 and I applied for extention and got approved on Oct10th'2003 untill Dec 2006. I went on a vacation to India, got my H1B visa stamped and for some reason got only untill Dec 14th 2003. Heres where the fun part starts: when entering USA, the I-94 issused by customs was untill Dec 14th 2003.
When discussing with my lawyer, he said "The last issued I-94 is the valid one". Now based on this my I-94(on H1B) untill Dec 2006 is no more valid and I will be out of status from Dec 14th 2003. My lawyer suggested some options:
1. Go out of the country and come back before Dec 14th 2003 with H1-B I-94 (Dec 2006) so that they will issue one more I-94 untill dec 2006.
2. Apply for a new H1B (premium processing) as i planned a trip back to India in Feb again.
Any suggestions and comments will be highly appreciated.
