  • Please Please help (problem on my Stamped H1B)

    Hi All:

I got my H1B stamped on October 2007.I'm still in India and I was planning to go in March 08. Now yesterday only I got email from my employer AA, that they have canceled my employment with them. Employer AA gave the reason that the Project XX for which they were bringing me to US got canceled. Client canceled all the contracts with Employer AA. During petition filing for me, employer mentioned that I will working on XX project in the application forms.
I'm very shocked to hear this. I'm also confused that they can always find another project for me in US. But Employer AA says that lawyers are working on it. I don't understand how this becomes the legal issue. I see chances are very bleak that AA will call me on another project. Can you please guess why the Employer AA is behaving in this strange manner.
Employer AA has not canceled my H1B till now. Is there anyway to use this H1b to find another sponsor and do the H1B transfer, before they cancel my H1B. Is transfer possible when I'm still in India? What may be the legal issues. Please Please give your suggestion.. I'm very upset!

    Thanks in Advance

    Hi

I dont see any reason why you should panic. Normally employers do not cancel H1 visas since it costs them money. All you have to do is to find someone else who can transfer your H1-B. Concact any firm in the US a d they would be more than happy to help you.

    All the best.

      don't panic

      Hi Friend,

Do not panic. Your visa is valid till the date it is stamped for. You can not work with the employer who has chosen not to employ you and no one can help it or guess the reason.

You can look out for another employer who is willing to employ you. Get a transfer of H1B and just carry the approval form and the new appointment letter and all the relevant docs of the new employer, which you can show it at the port of entry (POE).

Start emploring on new employers who would be glad to employ you because you have an approved H1B.

      All the best.
