  • H1 Visa Re-Stamping from Canada

    Hi,

I recvd my H1 extension approval last week, till 2006.

The H1 visa in my passwort expires in November, 2003.

The question is, if I can get my H1 visa re-stamped in my passport from Canada if I visit Canada before November? What are the risks involved?

Any thoughts are appreciated. Our attorneys gave a vague answer of 'not recommended' but 'technically possible!!'

    Thanks..

    H1 B REVALIDATION

I too have same type of Issue,
I have valid visa till mid of Nov,I got new papers(h1 approval).
Can I go to Mexico for Stamping for extension as it is taking too long at St.Luis.
Will there be any problem if something happens at Mexico.
Can we come back to USA?
    Ven

      Re: H1 B REVALIDATION

      See travel.state.gov/tcn.html
If for whatever reason the visa gets denied, you can not come back, even if your I-94 is still valid. From the same link:
"Effective April 1, 2002, aliens who have applied for and been refused visa issuance while outside the U.S. are prohibited from returning to the United States, even if they are in possession of a valid I-94 form."
