Need to apply for H1, passport expires in a month

I would like to apply for H1 on 1st april 2008 and my passport expired on 28th April. Do I need to get new renewed passport before applying for H1. If I must get, how long it would take to get the new passport.

there is still more than a month to get the passport renewed, and for h1 application in april you dont need the passport, that is only when you go for stamping
