Dear Sir,
My wife (H-4 VISA)is in USA now and is planning file H-1B in April 08. Is it possible for her to file H-1b in April 08 then go to India for couple of weeks and come back to USA w/o jeopardizing her H-1B application?
As someone told us that after filing H-1B she can't go to India to India for couple of week else her application will become void. And she needs to be here in USA continuously from the date of filing to 10-01-2008. I don't know how far this is correct.
Please advice me in this matter.
