  • H1 extension

    Hi,

I Switched job and my new company applied for my H1 transfer in March 2003. The H1 transfer just got approved and they have given it till Dec 2005, but my six years limit is only till Sep 2003.

During this six years I had been out of the country for 5 months.

since BCIS has approved it till Dec 2005 can I continue staying beyond Sep 2003( my six years limit)?

    An answer would be appreciated.

    Thanks.

    No...you can't

No..You can't. It is a mistake by INS. It doesn't mean that you can avail this. You will have serious problem while entering US again when they find out later on.
Dont' take chances. 6 years is counted from the date your first entry in US. Being 6 months out of the country does not count.

this is not a legal advice.
