H4 to H1 - leaving to india during H1B filing

Hi,

I am on valid H4B and my H1B might be filed on April 1st.
I am planning to travel to India during this month end and return on Apr 7th.

Will this be a problem in the H1 process? I am planning to return back on my H4 only?
whether there will be any problem for me to re-enter into US on H4..?

Kindly please advice me...

Hi,

It wont be problem but you employer has to raise the amendment with your latest I-94 once you back to USA. So that on bottom of your I-797 (you will this after your H1B approval) you will get the copy of your I-94, with this you can apply for SSN with out stamping itself. Which costs you arround $340
