Company A filed for a H1-B petition in April 2007 and was approved beginning October 2007. Meanwhile, I got a better offer from Company B and they filed for a H1-B in September 2007. The H1-B was approved and was not considered as a transfer of H1-B visa but a new petition, which applied towards 2007 quota.
I was laid off from my job last week at Company B.
Company A has still not cancelled my H1-B visa. Is my H1-B with them considered valid?
Also, please advice on the steps I should take to ensure that I stay in status.
I have brought some time (not a definite number) with Company B but mostly the company will be filing for bankruptcy in next few weeks. If they cancel my H1-B, what will be Company B's obligation towards me? Thanks for your help and in anticipation of a quick response.
