    I am currently on H4 VISA and have been volunteering my services as a Research Assistant in one of the B-Schools in NYC. I've been offered a full-time paid RA position by my advisor. I understand being on H4 its not possible to accept this offer. I need to understand, if I can apply for an H1-B visa in this scenario. Also, can I apply for a student VISA?

    If you want to start your job as a research assistant, you need H1. On a student visa, usually you cannot work - (there are some exceptions). My friend has been on H1b and went to school but he did not need F1 to go to school.

      I do agree with you. Let me add few more lines on H-4/H-1/F-1 query. You are supposed file F-1 within 6 months of time when you were on H-1. If you file your F-1 after 6 months on H-1 then you will get a query stating to provide your leagal status at the time of applying for F-1 by means of pay stubs or letter from the employer.
