Valid I94 & expired petition - H1?
Hi,
When I entered US in Sep 2006, they gave me I 94 until Sep 2009. My Petition and visa expired on May 2007.
When I wanted to initiate the petition approval process (before May), my company asked me not to extend the petition as I 94 is valid. Is that true? Is it legal to stay and work in US with valid I 94 and expired petition and visa.
Also, can I apply for my H1? (with above explained scenario) Will it create any problem?
Also, after applying for my H1, can I trave to India in July 2008? ( I will be applying for new L1 petition through my current employer)
Please help me.
