B1 Visa to H1 Visa

I was working on H1B visa.I recently lost my job then I immediately applied for change of status from H1B visa to B1 Visa with USCIS. And the case is still pending. If I get selected for another job in the mean time can my employer apply for H1B with the USCIS while my change of status is still pending ?

Yes, you can do that.

However break of H1 status is obivious and you can not provide latest pay stub so your H1 petition approved without status (i.e) with no I 94. In this case you may have to restamp your H1 before start working.
