Hi..

I am on h1b here in usa. Planning to go bak to india . Is it possible to do H1 transfer from india.

I was speaking with a consulting company , they told that they can d it thru 'Consular ' process.

is it so.. pls hlp

Different meaning of H1 transfer

Meaning of h1 transfer

1. H1 transfer without affecting your current H1 status - Reqd; valid I 94 and proof of non violation of H1 status.

Once transfered you get I 94 at the bottom of your H1 approved notice, no need of visa stamping before start working with new h1 sponser.

2. H1 transfer - no status.

Can be done while you are outside (US) same as getting a new H1 without quota issue.

But you need new visa stamping and I 94 to start working with new H1 sponser.

Meaning of h1 transfer - Thanks but small doubt

H1 transfer - no status.

Suppose I go for H1b transfer - no status .

In this case if i stay 1 year outside USA then will I get 6 years again?

If so how do they calculate that 1 year .. the time we apply new petition or the time when u go for stamping?

If you want fresh 6 years, you must be physically stay outside US for one year and apply H1 under quota, no transfer business.
