  • Applying new H1 - Have L1

    I am on a L1B and filing for a new H1. Now my consultant is asking whether to choose change of status or Consular processing.

    1) What is the difference between these two?

    2) I don't plan to shift to H1 immeidately in October. If I want to shift in say Feb 2009, which is the best choice?

    3) If I choose Change of status while applying now and if I do not change my status to H1 in Oct 2008, will the H1 become invalid?

    2) I don't plan to shift to H1 immeidately in October. If I want to shift in say Feb 2009, which is the best choice? Go for new H1, as soon as you are ready go out of US for H1 stamping and re- enter with H1.
