My spouse was here in US when she received her H1B approval along with her I-94 with a starting date of 1st October. Until the first week of November 07 she did not commence her employment (project).
She recently received her employment letter from her employer for stamping and her start date was mentioned as Nov 07. Upon contacting the employer, it was told that her H1B took effect from the actual work start date, but not the H1B I-94 effective date of 1st October. Also, it was told that until the actual date, she was on H4.
However, we still are confused as to whether her H1B took effect on 1st October automatically or the date she commenced actual employment (Nov 07).
Any valuable suggestions on the above would be highly appreciated.
