---- Yes, you can apply. The petition may be approved as you will not be counted under the quota. Of course, all you want to do is apply for a H1 from a different company and then choose whom to join. In the event be prpeared to face the consequences of even legal proceeding by an employer if you do not join them. This is irrespective where you reside in the world, meaning that you need not be in US to get sued
