Hello,
My wife was staying in US on H-4 status. Visa expired on March 2002. I moved to new company on January 2002. They are applied both H1 and H4 and sent these application through ordinary mail to INS. I got my receipt number and approval notice on March 2002. But I didn't get my wife H4 application receipt number and approval notice till now. My wife visa is expired on March 2002. I think my wife application is misplaced. I don't have any proof of application submission, even with my company too. Attorney was sent so many queries to INS with my wife name. They not replied for single query.
So what is my wife status? She has any grace period to apply for H4 or not. Without H4, now she can apply for new visa in consulate or not. If she applies in consulate, any chance to reject to give new visa on illegal status basis. So what she has to do? Please help me.
