Problem in my H1B status

Hi,

My H1B is under transfer. My spouse and kid who are under dependent H4 visa are in India now. My former employer is threatening me with visa cancellation.

If my former employer cancels the H1B even before my new H1B is approved, would my family be able to enter into the US?

Please help.

Don't panic. No employer can cancel your visa or recommend the cancellation of a visa.

The employer can fire you or close down the company and you become out of status.

In order to continue working on H1B, do a transfer to some other company so that you are in status and your dependents would continue to hold H4.

Search for a new employer and get your H1B transfered.

As far as my knowledge goes, employer has nothing to do with revoking a visa except that the emplyer helps you in keeping up with the status.
