  • H1 Transfer please help

    hello everybody,

    i am in very big trouble please help me if anybody can. i came to us on H1B visa of company A. they lied to me that they have projects running in other companies and they will place me directly on project on approval of H1B visa. now i am in usa from last 4 months with them and they are not paying me anything instead they are telling me to show **** experience of 6 years in IT field and than i will have to attend interviews telling that lie. i don't want to do anything illegal. they are not letting me go anywhere. i have a job offer from company B and i want to transfer my H1B visa on that company . but i think i cannot do it without two paystubbs of my Company A. can anybody help me with that. please i am in big trouble. if anybody can help me i will be really thankfull to you.

    In the job market here, its all about lies and fraud. Honest people like you who dont want to indulge in lies about their experience will not get any job here unless they get real lucky. I have been in this scenario and have feared faking experiences. But the truth is, this happens in US where the clients do not care about your service certificates.
    So my advice is to adopt the wrong way to get a job as they are insisting.
    As far as H1b transfer goes, you do need paystubs but I heard that some companies even generate **** paystubs. If you new employer is another desi consultant, he will surely know some way.

        I condemn the post of jineebhat suggesting and encouraging to **** experience on resume. Not everyone is like you and millions others here. There still are ppl around who have the guts to go in with true experience and get jobs. Ever tried a permanent full time job with **** experience? The background check will throw your candidature out, in the trash even if u have cleared all the interviews and also blacklist you. You can get only consulting jobs with false experience for which u'll have to hop cities every 6 months or so and have no assurity of new jobs once the old one runs out.

        Akhilyadav, its true that pay-stubs are needed to transfer visa. A friend of mine was exactly in the same situation as you couple years ago. He approached his company to give him a letter on the company letterhead saying he needs to show such a letter to the DMV for drivers license and to the apartment leasing office to lease a new apt. They gave him a letter saying he is an employee of the company etc. and he used that letter to successfully transfer his visa to a new company, not a desi consultant company (for gods sake), for a full time job is happy ever after that. Mind you I just related a real life story to you with no guarantees.

        If you have a new permanent full time offer then ask the company if they can let u be a consultant in their company for 2 months and then go on full time basis? You can use the pay-stubs from that 2 months to transfer visa, this way has worked for.... none other than ME! for a full time job, and I am happy ever after tht.

          Mind your words before you speak and write. I dont know how a person like you survive in such a good forum and gets a title as Senior member. You acted like headless chickens without even knowing the gist of my post.
          Regarding myself, I have been forced to **** but nowhere in my post I said that I actually ****d?

I find a person here who avoids faking experience due to a fear that he may get in deeper troubles. I feared the same but was lucky to get a good comp (annual turnover 1 bn +). MY INTETIONS ARE TO HELP THAT GUY WHO IS IN NEED. TO COMPETE IN US, YOU NEED TO **** BECOS YOUR OTHER COMPETITORS ARE DOING THAT TOO. In US the successful people are not who knows more but the ones who pretends to know more. People like you who give big lectures but MAY themselves have used their chacha mama company to get H1b and finally GC. Well, am learning to get personal like you get when you write a post

              I got my H1b visa transferred from a fraud desi consultant to the company I was working for at that time. I too had no paystubs. However, it was just Oct and maybe thats why the attorneys of the transfer company said that they don't need them. Maybe you ask the new comp attorney or any other attorney. He will guide you in the best possible manner.

                I agree jinnebhat. People already established here think its as easy as it was few years back and pretend being saints. Moreover they have the habit of lashing individuals on forum here. You are right that people here show wrong years of experience and those who deny are just joking. Ofcourse, this is not in all cases but can still be termed generic

                  Hi Peers

                  Went through your discussion and as detailed everyone who is looking for jobs are forced to **** their experiences though haviong worked elsewhere whether they like it or not. But my question here is cant we get a permanent offer with those experience. Please throw me some light on background checks as i am new to US. Please help me

                    buddy please consider my problem as well . i think you all went on another topic. i don't want to **** experience because i have a job offer from company based on my education. my question is how to transfer H1 without paystubbs.

                        I am not here to flame anyone personally. It does not matter who advised to ****, my response would have been the same. I try to help here, and I do my best with whatever I know. The faking business is not a small issue, its a real BIG issue here. Take the faking business out and millions will be returning back home on the next flight. And if I continue to write about it I am sure it will embarass the whole community here and this thread might end up getting deleted too ultimately. I wonder why desis only need to **** and no one else even thinks about doing that. Its disgusting. Thats what it is exactly.

                        I would not have written what I did because I too was in the same boat just a couple yers ago as OP, with pressure from my employer to ****, but I did not and struggled my way through, I was shocked even at the suggestion of it by them. But have gradually realized how widespread this disease is and I hate it all the more everyday. If I would have gone through a chacha mama company then also I would not be writing this.

                        Finally, faking is wrong, right from the thought of doing it. And of course ethically too. And so if you ****, you be ready to hear this or from me or anyone who does not. Its the same situation you'll be in as when your employer suddenly finds out that everything in your resume is nothing but lies, you wont have any justification, excuse, explanation or a face to show them. It'll be best to leave on your own before they fire you. And this not to anyone personally and this is to everyone who ****s. You might not like what I just said, but deep within everyone knows that I am right and faking is just not acceptable. You might get away with it today, but it'll come back to haunt you tomorrow.

                        Lastly, I dont care what my title is. Merely make 100 posts and you'll be come a "Senior Member" too, even if all your posts were 100 questions. Thats the little secret unfolded, if you are so interested to become a senior member. I believe that I have been able to help ppl here in the past with my knowledge and I'll continue to do so, out of my own interest.

                          Hi forum members,

                          Let's try hard not to use harsh words to pour our mind and emotions out. Let's all agree to disagree but with respect to each other.

                          Let's not bring in a country's name directly or indirectly, again, just out of respect for that country in discussion. A nation shall not be judged by cowardice and malpractices of some companies.

                          All said and done, the original posting by the member states very clearly that the member did not want to indulge in any malpractice at the time of posting. And I have no moral conscience to set myself as an example of surviving in the US, which might have been through malpractices.

                          Two wrongs do not make a right, even if the wrong is repeated by all people. The values and principles one has does not change under any circumstances and that's why such things are called Principles and values.

                            The correct thing to do is

                            Have your new company file, but it won't be under cap; leave the country and once you receive the approval notice, re-enter using old stamp and new approval papers.

                            You may NOT go to work immediately if you do not qualify for a transfer - having pay stubs, etc.

                              and what would i say to my current company people ? they are telling me to fire me if i go anywhere now. they don't let me go away from their guesthouse
