What timing

I have a very urgent question. Any help would be appreciated.

I am currently on H1B which is expiring on July 8 2008. I have filed for my H1B extension last week.

My wife is currently in India and has a H4 which expires on the same day (8-July-08). She has an offer from a US company and wants to apply for H1B this year.

The question is can she apply for H1 B (new) and as well as H4 extension? If she applies for H1 her approval will take some time, by the time her H4 gets expired. If she comes to US on H4 and files for her H1, can she then file for her H4 extension since her H4 expires in July -8?

---- What are you talking about? Since you are on H1 and also extended it, you should know tha whole process by now. If your wife is on H4 and wants to apply for a H1, today is not the day to pose the question and enquire about details about how and what.

---- By this time your wife should have applied for the H1 as April 1-5 are the only days applications are accepted. Today you are still thinking of applying and your wife is in India while on H4!!! A miracle can save you if you send tha pplication in the next couple of days

----She cannot come to US on H4 and apply for H1 in this years quota (unless she has already applied for a H1 from an employer while she was in India). She can only apply for the H1 in the year 2009 and you have to wait till that time.
