  • H1B visa stamping in Mexico

    Hi,

    I came across your website (www.immihelp.com) and it was extremely helpful. I have a couple of questions, would appreciate your prompt answers to them.

    Here's our current scenario:
    - We are Indian nationals staying in Los Angeles.
    - I am on H1B visa (valid till Oct 2008), and my wife is on H4 visa (valid till Oct 2008).
    - We had applied for my wife's H1B in 2007 quota, but she had to come to US on H4 visa during June 2007, before getting her H1B visa.
    - We could not plan our trip to India, therefore we are considering going to Mexico to get my wife's H1B stamped, based on the same 2007 petition, ASAP.

    Here are my questions:

    1) Will we be requierd to take Mexican visa, or our H1B and H4 visas are good enough to enter Mexico and re-enter US?

    2) If my wife gets her H1B visa approved/stamped in Mexico, then I understand she will be given new I-94 while re-entering US. But, what if her H1B visa doesn't get approved/stamped in Mexico - will she be allowed to re-enter US based upon her existing H4 visa (valid till Oct 2008) ?
