  • H1b Transfer - Do's and Dont's

    I am planning to transfer my H1b and my new employer has reqested me a list of documents .

    Request to help me for the following :

    1. Is there any things which I should take from him when I give my papers.
    2. What kind of obligation will he expect from me. If he is taking the cost.
    3. I have discussed my salary and benefits with him. Should I ask for my joining letter/agreement now or later. When is the right time.
    4. What are the do's and donts when giving papers from H1b transfer.

    Anytime I see people referencing the employer as "him", I think the employer (he) is like a convenience store owner. There is good chance that "he" will do you no good and probably will do you. BTW, nothing againt store owners and the way they operate.

    So be careful. Don't give "him" original documents. Don't pay him. You did not even ask "him" whether he will bear the cost of H1 transfer.

    How did you accept the job without even getting a written offer among other things?

      You already have started with the donts by agreeing to pay them for the H1b transfer. Ask about any agreements that you have to sign and serve for the rest of your life.

        Thanks a lot , now clarifying my situation

        I think I did not mentioned my question clearly, my case is that I have been discussing the offer with this new employer. The new company has agreed to pay the H1b Cost , I am NOT paying anything.

        Now what I wanted to understand was, does the offer letter/agreement comes after the H1b transfer or before, and can I ask the offer letter while giving the papers, what is the practice ? When would I become the employee of the new company , after the H1b transfer or when I join a new project thru them. Please help me understand.

          Offer letter is the first thing in the process. Offer letter need not have a start date on it but can mention something general like "Upon transfer of the H1b visa". However, you can start work for new employer the day H1b petition is received by USCIS.

          You would become their employee the day you join or report to work for them after the H1b petition is filed.
