    Want to know if

    a.) An H1 visa holder after having worked here in IT field for 4 years and now wants to do some odd jobs since he is in the bench for 4 months and out of status. what if he do the following

    can h1 worker join any manufacturing/service related companies to work as any clerical/accountant/ job. Will they hire them? what makes the difference when he was working in techjob compare to odd job.

    H1b is for specialized occupation. A H1b holder has a job, with the employer all the time, project or not, does not matter. The employer owes minimum wages mentioned on the LCA. They signed a LCA under oath and perjury that they will pay a H1b holder.

    If the odd job requires a Bachelor's degree and you qualify, they can sponsor a speciality worker. On a H1b, you have to always work for your sponsor.

      Firstly, the job has to require at least a Bachelor's degree in the field. This person has to have the required degree and/or experience in the field.

      Example, if someone is in IT and had his H1 approved in IT because of his experience and/or education, it is almost impossible to get an H1 for a job in Biology since biology is a totally distinct field than IT and requires special education/training.

        Thanks for the reply you both, what i want to know is if a person holds a bachelor degree but do not have enough experience on his field for eg: if someone holds a commerce degree then he do not have experience in his major's so in this case, since he was working as an IT guy for the last 4 years and he has a family here too, in order to support his family he intends to do some clerical or account job, can he do those jobs easily.
        about LCA he does not have it currently, even if he asked his presently employer will he provide him remains the question?

            the question is considering if an h1b is in bench for 4 months can he easily secure a non-IT job. since an h1b is in bench his present employer is not paying any minimum wage as suggested by you.

              Based on B.Com (assuming Indian traditional 3-yr deal) only and no experience in the accounting/auditing field, this person does not qualify for an accounting job since B.com is not equivalent to a 4 yr degree in anything in the U.S. Every 3 yrs of experience in the field can be counted for every 1 yr of missing education.

              Tell your friend: Don't think about cooking experience in your dream and putting on the paper in the morning.

              Besides, recent pay stubs are needed to transfer H1. This person needs to get paid. This will help his status and his family that he needs to support.

                It'll be illegal employment. See whats on the back of your I-94. You will be subject to deportation.
