  • Student Visa to H1 Visa

    My son has entered US on student Visa in August 2007 and he has set to complete his MS in Dec 2008 instead of June 2009 considering he can get H1 quota in Dec easily on Postgraduate ( MS in Computer Science) quota in Dec.

    He thought on his regular completetion of study in May/June 2009 ( after 6 months) could dealy in getting in H1 quota of March.

    Will you please advise

    1 His getting thro H1 quota in Dec/Jan on MS quota basis is right or not
    2 He has more chances in Dec.
    3 What should he do now since he has opted subjects to get more credits and he can complete by Dec 2008.

    If he graduates in Dec, he can work on OPT and find a sponsor to apply for H1b in advanced degree category in April.

    Now that the OPT has been extended, when he graduates will have less impact on applying for H1b unlike earlier.

      1 I heard there will be lottery system for H1B.
      Since if he applies in April under Special category --Postgradute quota--( which I suppose 20000 at present),how are the chances to get it.
      For 65000 quota the applicants were more than double within 2 days here in above case what was the position last time.

      2 Can he visit India under OPT frequently without any problems.

        No one knows what's going to be the case next year. This year there were 31,000 petitions for the 20,000 Advanced Degree cap. Those not picked in the 20,000 lottery are given another chance in General cap. So, an Advanced degree petition has two chances.

        Your son can travel on OPT if he has a Job/Job offer, valid I-20, a visa.

        Your son should read about new regulations pertaining to OPT students.
