  • H1B transfer: "Cancelled Without Prejudice"

    I have a H1B stamp on my passport from Infosys which was valid from Jun 2004 to Jan 2007.

    I left Infosys and while getting a B1 stamped in Jun 2005, the H1 was "Cancelled without prejudice". After that I stamped a F1 Visa for masters - Now my Masters is complete and I was wondering if that previous H1B can be transferred and renewed?

    Please help me know if there is anyway i can avoid the cap.

    Yes, you can use the old H1. You may not be cap subject and your employer can file your H1 any time and you may get the remainder H1 time (which I believe is full 6 yr in your case). Search FAQs on Immihelp H1 section.

      I believe this is valid even though I have never worked on my old H1B ever? One of my friends who was in a similar situation did get his Visa renewed. I was just in doubt because it has expired more than a year ago...
