Urgent - Want to know my status

Hi,
I need Help. I came to USA on H4 visa.

After getting a contract position, I filed my H1 through some consultancy.

By the time my H1 is approved, I lost my contract.

H1 is approved now.

Now the consultancy is holding my H1. They didn't issue me neither an appointment order nor the H1.

they also didn't include me in payroll.

Now my question is what about my status.

Is it H1 or H4??

Is my status becomes Out of status here.

If you never worked for the consultant, your status remains H4. You might want to confirm this with your spouse's attorney.
