  • L1 TO H4 Info required

I'm on a H1 visa and my wife is on a L1 visa.
    1. Since she is expecting baby, will it be possible for her to go on unpaid leave from her organization and still stay on L1 visa?

    2. Is it possible to change her visa status from L1 to H4? If yes, how much time it takes for change in status? Do I require help from an attorney for this?

    Thanks in advance.

      1. Yes, provided she is still employed and plans to return after the child birth. Most of the companies are required to pay by law for exempt employees during FLMA.

      2. It is possible to change to H4. Fill up form I-539. You don't need an attorney if you have the time and patience to research and fill out the forms, include documentation needed and send it.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
