  • Trasnfer of my Green Card approval processfor new job

    My Green card was filed in EB2 category in Nov 2007. My labor was approved in Feb 2008. My I140 was filed in Mar 2008. I am planning to join a new employer. Can i have my Green card transferred to the new employer?
    Do i need to wait until a certain period to do this?

    If you are moving then you'll have to start from scratch.

        If you change your employer, you will have to start the process (PERM, I-140) all over as Orion suggested.

        If you have a copy of the I-140 with your current employer, I think you can request to retain the Nov 2007 PD when you file the new I-140 with your new employer. This can be done when your new employer files for the I-140

          You can however capture the Priority date from your previous approved labor. Try to get a copy of the approved labor from your old company or the copy of I140 if approved.
