      Visa Renewal Criteria

      Guys

I came to U.S on F1 visa and converted to H1b on Oct 2007. I have not been to Stamping after I got my H1b. Now I got my H1B renewal and I'm going for my visa to Chennai. What should I answer the following ?

      - Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*

This is the line I'm confused about - Applicants applying for a different visa class (e.g. had a F1 student visa, now applying for a H1 work visa).

I had H1b for 3 years also and have not been to Stamping. Now I'm going for my second term.. What should i answer for this question..Any help is appreciated..

      Thanks
      Karthick

You need to answer "NO". If you would have searched the forum with this question, you would have found a lot of similar posts answered. The question clearly asks about your visa (Not your petition). Since your last stamped visa was F1 and the one that you are applying now is H1B, you need to answer "No".

Is there any advantage in getting your visa stamped within 12 months of expiry of your previous visa?

          Pl. advise.

No (Unless you have an extended petition and want to get it stamped to avoid any transit visa issues in European airport transits in future). Visa is just an entry document. You need the visa only to enter U.S.

The question in DS-160 is different though. It asks whether the visa has expired within the last 12 months or it has expired long before 12 months.

              No dates with delhi consulate?

              HI,
I have a business visa and am in US right now. My employer filed my H1B which got approved in the first week of november.

I am trying to take a date from delhi consulate for appointment and looks like there are no dates available as in the available dates link it only show some dates with Chennai and kolkata consulates.

Is there a way or link by which I may check available dates in delhi consulate?

PLEASE HELP, I have my tickets booked and planning to stay for one month in India.

                H4 to F1

                Hello,

I am going to India in December. I have valid I 797 of F1 visa. I changed my status from H4 to F1 in March 2010.

What should I answer for the question

Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*

I think I should say YES, because my F1 is currently valid. Am I right?

                please reply ASAP.

This question is been answered very frequently in immihelp? Did you trying searching for similar posts?

Visa and petition are two different things. The question clearly asks about the visa that is stamped in your passport. If your previous visa is not F1 and you are applying for F1 now, then you need to answer NO.
