Immediate help plz On my query

Dear all,

My spouse having H1B now presently working in US. She wants to stay with me for 10 months in India. Is there any Problem If she stay in India for 10 month???

I want to apply H1B next year April but Can i direct apply for H1B or Can i apply from H4 to H1? Which way is better for me??

She can stay in India for however long she wants. When she comes back though, she will need to have a job (letter or offer letter), a valid H1 approval (I-797), and a valid visa.

I assume you are in India. You can apply fresh from India OR come here on H4 based on your wife's H1 and apply for an H1 from here. Your choice.
