  • I-824 FILING

I am on H1B and my current H1B is expiring in Feb, 2002. I got my visa extension notification(I-797) and I sent a photocopy of I-797 along with my passport and other required documents to St. Louis for stamping in the first week of January,2002. But am not sure if I will be able to get it revalidated my 2nd week of march when I am planning to travel to India. If I cant get it revalidated here and have to get the visa stamped in India do I need to file form I-824 with the INS or I can simply go to the Chennai consulate in India(my previous visa was stamped there) with all the necessary documents and get the visa stamped. Please advise.

    I-824 FILING

I-824 if for immigration process when opting to change GC processing from AOS to CP.
So, like you have already thought of, if you don't get your revalidated visa by the time you leave for India, get the stamping done in India. Remember to take all and exhaustive supporting documents with you.
    Hope this helps. Good luck!
