    Hi,
    My I-94 is expiring on Aug 6th 2008. I applied for EAD
    extension and got new EAD. The old EAD was expiring in May 2008. So we
    applied for EAD extension in jan 2008. We got new EAD and it is
    expiring on Aug 6th 2008(same date as I-94 expiry date). My husband's employer is applying for I-94 extension and l1 /l2extension. We
    will get new I-94 in Aug 2008.

    Can I apply for EAD extension now or after getting new I-94? Is the
    date on new EAD (aug 6th 2008) correct as EAD is normally extended for
    2 years?

    If we get I-94 in Aug/Sept 2008 and then we apply for EAD extension,
    it will take another 45 days for EAD approval. So should I stop
    working till I get EAD extension?

    Please clarify

    EAD expiration date is actually expiry date mentioned on I-94.
    So you will have to apply for an extension with new I-94.

    So, you can not work unless you have valid EAD.

        First you need to get I-94 with extended expiry date then apply for an extension of an EAD.

            Here is a link to a form

            It asks for I-94 number. You have only 2 choices. Either apply for an EAD extension with current I-94 OR get new I-94 first then apply for an EAD extension.

            Again: your EAD expiry date is = I-94 Expiry date.

              I do have a similar scenario,

              My EAD and L2 is valid till june 20 2008. I am working with my EAD as of now.
              So the only solution to this is:

              Apply for L2 extension.
              Only when it gets approved, I can apply for EAD that too a new one.

              Questions:
              1) Can i apply for EAD extension or should I apply for a new EAD?
              2) Can the EAD be applied after I get the L2 case received but pending notice or can I apply it only after I get L2 approved?

              This is very urgent as I am already late for applying my extension.

                1. Both mean the same. What is the difference? EAD extension results in a new EAD.
                2. It has to happen after approval.

                  Just one more question:
                  1)Any idea as to how long the L2 extension and the EAD extension will take if done in the sequence as mentioned ?

                    Check your service center processing times online at USCIS.gov Application type would be I129 and I765. It could be 3-6 months for I129 and 2-3 months for I765.
