Is H4 valid if I change employer?

I am on H1 with employer ABC. My wife & son got H4 stamping done in chennai. They are still in India. I am planning to move to another employer XYZ. While the H1 transfer is in process will there be a problem if my wife & son travels to US? OR Should I wait till the transfer is done and go for another H4 for wife & son? Pls. advise.

New H4 visas are not needed as they are not employer specific. They can enter while your application is pending. It will be good to provide your wife with the receipt notice if you have already joined company XYZ. If you have not joined XYZ, don't bother as there in no need to provide unasked information.

Once they are in the U.S, make sure to pay attention to their I-94s as the I-94 dates determine their period of authorized presence. Their I-94 dates will be different than your new I-94 that comes with the XYZ I-797 after the case is approved.
