    Hi!

    I entered US on H4 visa in 2007 and got my H1B approved in the same year. I have my I-797 along with my I-94 and also my SSN. My H4 is going expire in JULY 2008.
    I have an appointment for my H1B stamping in Mexico for JUNE 2008, as i'm planning to travel to India this year.

    The problem now is that i havent got job yet due to the slow down in the job market! My question now is, shall i continue and get my H1B stamping done in Mexico or should I go for an H4 extension alongwith my Husband H1B Extension.

    Also, if I go for a H4 extension, will my H1B be cancelled?

    You are currently out of status without getting paid on H1b. H1b requires one to get paid right from the start date of approval of change of status.

    You are not on H4 status and H4 extension is not possible.

        I have a suggestion but I am sure you won't like. Complain to DOL on WH4 for unpaid wages. The employer is required to pay you, project or not.
