  • L1 to H4 Status

    Hi,

I am currently on L1 visa working for an Indian company here. However, I have two visas on my passport, H4 and L1, when I entered USA, I was on H4 and my I94 was on H4. After I got a job, i re-entered USA and currently, my I94 is based on my L1. I am planning to quit my job due to some personal reasons. So, what would be the status of my I94.Since, I have my H4 visa, can I stay here or since the I94 is on L1, will that matter? Also, due to health constraints, I want to avoid travelling. Is there a way out for this, to stay in USA on h4?

Before you quit your job, you should apply for a Change of Status (COS) from L1 to H4 based on your spouse's H1. This is the only option since you do not want to travel. You cannot just assume that when you quit your L1 job you will fall back to H4.

I believe you will use I-539. Check USCIS processing times.
