  • Is the lawyer's statement true?

    My H1B Visa expires on July 31, 2008. I applied for my H1B extension and got my second H1B which expires on Nov 2009.

    I applied for the LC under EB3 process. My LC got approved May 2008. My lawyer advises me to apply for I-140 before Nov 2008. Lawyer’s statement is “PERM application filed on my behalf has an expiration date Nov 23, 2008. So, the I-140 petition must be filed prior to this date.”

    My question is, is the lawyer statement true?

    Anyone’s help is highly appreciated.

    PS: He is charging $ 1000 as legal fees, $ 475 as INS Fees and $ 50 as miscellaneous expenses to file I-140 application. I am thinking now that just to get his legal fee, he is hurrying me.[/SIZE][/SIZE]

    Approved labor has a validity of 6 months before which I140 has to be filed. The charges also seem reasonable.
