  • help needed re: H1b stamp abroad

    Hello,
My brother came to U.S on F1 student visa in 2004 but apparently worked off campus for a couple of months with his SSN without authorization .The school authorities did not know of this incident.I contacted the school international office last month and they indicated that his SEVIS records reflected that he maintained a valid F1 status while in school. He completed his degree program and got approved for OPT by USCIS which expired in Jan 2008 and he left U.S within 60 days grace period and has been back home since then.

He now has H1B approved this June 2008 and he is planning on going for visa stamping in my home country soon.
He is deeply worried, concerned and scared that his previous unauthorized off campus employment might be found out at the embassy if he goes for the interview and thus becoming a big issue.

I will appreciate any one's input and opinions as he is very troubled now.
Anyone with similar experience should share with him please.
    Thanks.

Illegal work is viewed harshly when it is detected. It may not be for H1B but definitely more likely for green card and citizenship.

If either of these are his goal, he would be better talking to a lawyer to assess whether it is worth his time to work in US when he may have no chance of remaining due to his illegal activity.
