  • I-94 extension

    Hi,

I have a question on my I-94. I am working in a software company, through the same company I came to US on H1-B visa. My Visa, petition and I-94 are all valid till July 08 2008.

As my initial plan to go back to India by June end, so I have not applied for visa extension. But now client and my project manager wanted me to stay here for couple of more months. I am applying for visa extensionnow at this late hour.

But I heard that to get receipt note (acknowledgement card) on my application takes 3 weeks. Would that be fine if I stay here without that receipt notice even after my I-94 expires? Is that be treated as overstay and will I be facing any problem during my exit time or next visa interview time?

    thanks,
    Raj

You can work for up to 240 days after your current I-94 expires if you have filed an extension before the I-94 expires.
