  • H1B Transfered, joining delaying, amendment required?

    Hi,


    I am in US currently working on an H1B on which I travelled. I just got my H1B transfer approval for my new employer, validity details:

    Starting Validity Date: 06/05/08
    Ending Validity Date: 05/14/11

    I will be able to join them somewhere in Sept 30 2008 because my current employer wants me to work with him as per the contract I have with him. Negotiations are notworking.

    1)Is there any amendment in the new H1B required to me made by the immigration(through my Employer/Attorney)?
    2)What are the steps that my new employer needs to follow to allow me that?

        I am worried because I talked to my employers Lawyer and he says he needs to file it again.

        Is there any clause/extract which I can refer to him?

          As long as you do not have a gap in employment or status, you should be fine.There is no such rule or obligation to work for the new employer immediately. As long as the new employer does not cancel the petition, you can join them after the project gets done.

          Geez, where are all these misguiding lawyers coming from? Time for me to embark on law school.
