Question on spouse with B1 coming as a visitor

Hi,

I am in US for a short trip on H1. I am planning to go back to India by Aug 15th. I am planning to have my wife come to visit me for a month on a vacation.

She has a valid B1/B2 visa from her company. Can she travel with that visa as visitor and meet me. Is there anything I need to take care of to answer immigration authorites ?

I don't think so.

The visa was issued for business visit and may well have endorsement stating the same. She may not use it for pleasure visits.

She could possibly travel as a visitor on her B1/B2 if her travel plan is well defined and there is no annotation "B1 issued in lieu of H1".

If the POE officer thinks she is coming here to stay as a dependent, she will be turned back. Let her carry proof that she is returning soon, leave approval from the company etc.

Best bet is to apply for a H4 and the B1/B2 will remain intact.
