H4 VISA renewal and US Stay

Hi,

My H4 VISA expires in September 2008. My Husband's H1B extension has been filed by his company in June 2008 and we are awaiting his receipt number. After which we shall be filing my H4 VISA extension.

My question is, can I stay in US beyond the date of expiration of my current I94 if we have applied for my H4 VISA extension and it is still in processing.

You need not wait for H1b extension approval to apply for your H4 extension. Generally, both are done together. Go ahead and apply using the copy of the H1b extension I797C receipt.

Yes, once the application has been delivered to USCIS, one can stay until a decision is made. It is period of authorized stay by the attorney general.
