L1A to H1B

  • L1A to H1B

    Hi I am in a situation where I need your guidence/suggestion. I am on L1A visa from Employer A which is valid till sep 2009. This year I have got H1B COS with employer B. I suppose I would be getting new I-94 valid from Oct 2008. Now I am want to continue with employer A (with L1A) atleast for another 6 months. at the same time I do not want to loose H1B also. I have few queries.

    1). How to retain L1A status atleast till Jan 2009? and what are the options I have
    2). what happens to my H1B visa if I am still on L1A visa
    3). can I later, while in US , apply for change of status from L1A to H1B in the month of Jan 2009
    4). how long does it take to change status from L1A to H1B COS
    5).are there any other things needs to be considered

    Please help me with the above queries

        Here you go, sir.

        1. Search for Leapfrog word on the forum using the search functionality and go through the posts.
        2. Nothing if you followed #1. You mean H1b petition right? Not Visa. If not, you would have a lot more problems to deal with in the future.

        3. Yes
        4. 2- 6 months
        5. A lot. Once COS is approved, no work permitted on prior status. This leaves no room for notice period or things of that nature with your old employer.

            Did you try looking? Go to immihelp.com. On the left hand side, there is a H1, H4 link. click on it. Then again on the left hand side, you will see a FAQ link. Click on that. More clicking there for FAQs.

              I messed up the question.

              Sir based on your answers I have another question. while travelling out of US. I would be having L1A-I94 and H1B-I94

              do you suggest that I should return both? just in case If I do not return H1B-I94 and keep it with me ( I mean I am not sure whether my employer will give H1B-I94 to me or not) ?

                There is no govt issued FAQs to answer all your questions that I can point to. Your questions have been answered if you took time to follow the instructions given so far.

                The rules are mostly interpretation of laws and you can go to a lawyer to get official info. The H1b I-94 has no meaning or value if you leave before Oct 1st as its validity is only after that provided you remain in the US.

                You really need to understand and spend time understanding the immigration law or talk to an attorney.
