Resetting H1B

Hi,

I have a question regarding resetting of H1B Visa.

I left US on 11th Aug 2007 at around 4:00 PM and I am planning to return
on 11th Aug 2008. Because my school is starting on 11th Aug I cannot
postpone my travel plans.

My question:

Since I left on 11th Aug 2007 and will be landing in US on 11th Aug 2008.
Will it reset my H1B Visa. What is the policy ( 1 Year or 365 days). If
its 365 days then I would have stayed out of US for the same (since Feb
2008 had 29 days).

If the policy is 1 year I would like to know whether there is any option I
have to reset my H1B since I have completed 5 years 7 months in US.

If your new H1 was counted against the fiscal year cap, it would reset.
Otherwise, it wouldn't.
