Travel during L1 to H1

Hi,

I have one query regarding my visa status. Currently I am on L1B on my company's behalf. I have applied for H1B with Change Of Status this year through private consultant. My H1B has been approved. Now I would like to goto India on vacation for 2 weeks in August.I would come back in middle of August on my L1B. Will there any problem with H1B COS because of my travel. Please advice on this matter.

Based on the Efren Hernandez memo, your status will change to H1b on Oct 1st automatically and you cannot work on L1 after that. You can go to a USCIS office with the H1b approval notice and get your I-94 from POE changed to show H1b as your status.
