    Hi All,

    I have my first H1-B Visa valid until Dec' 2008. However my I-94 card was issued until 14th Oct 2008, because my passport expires on that date. I have renewed my passport ever since. Also I'm going to change my employer who is going to file for a H1 transfer on a premium processing basis next month (August 2008).

    My question would be if I were to start my H1 with the new company in September would I have to leave the county on 14th Oct to get my visa and I-94 stamp renewed or is it okay that I could stay back and go for a stamping at a later date.

    As long as a new H1b extension or transfer is filed before your current H1b expires, you could stay. Visa stamp is needed only for travel.

      I-94 expiry

      I think, you will have to go to USICS office with new passport and get a new I-94, that will have the same end date as your H1B.

      I am also having same situation and I am going to USICS local office on 22nd. Will update you more on this.

        USCIS local office will not extend I-94s issued for less term due to passport expiry.
