  • HELP! Premium processing!

I would like to know if USCIS will exactly follow the 15 days in premium processing, my employer had filed my H1b non-cap visa last july 10, but they issued an RFE last July 16 asking who the other petitionee that my employer would like to petition, since he put in the file that he wanted 2 petition 2 people but my paper is the only one he passed there, so the Immigration had asked him on RFE who the other petitionee is, thats the only question they asked on RFE, my employer had faxed his response already on July 21, so Im thinking if USCIS will release the result of my visa on the 15th day of the premium processing or they will extend more for few days after they received the fax from my employer. Cuz I think they will follow the 15 days agreement if there is no RFE, but I dont know after my employer had responded on the RFE if they will need more time before they will release my visa. THanks!

The clock gets reset on RFE. Once the RFE response is received, the clock starts again for 15 days more.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

My employer had called Cali USCIS and they said they have received the response from my employer thru fax the RFE, and u said the clock gets reset from the date they received the reply for RFE, so Im thinking why they didnt update my online case when I checked my Receipt# online, it still says there that an Additional evidence letter was sent, they didnt say that they received the response but accdg to my employer Cali USCIS had received already his response.
You think Cali USCIS will really follow the 15 days premium processing and not 60 days?
      Thanks!
