Hello all members. I'm new to this forum.
I've got my H1B filed this year and it's still pending. The employer filed with COS from L1 to H1 without my knowledge. I want to continue working on L1 as long as I can but since that person applied with COS, I have to leave L1 job and join new H1B jon on Oct 01 2008.
This is really bad thing that has happened to me.
Can I ask the employer to revoke my H1 before Oct 01 2008 ? If USCIS does it before Oct 01, per your earlier replies to other threads, I'll fall out of status from L1, correct ? Please make my understanding clear.
If L1 falls out of status, can I go to to India before Oct 01 and come back after Oct 01 with my L1 ?
If USCIS revokes it after Oct 01, I'll come to US with L1B and will be on L1 B till it is valid.
In this case, can if my H1 gets revoked, can I transfer my H1 to a new employer ? I think yes. Please confirm.
