Status - H1 and H4

Hi all

My Husband has joined me on H4 visa.When we came to the US he applied for a H1b..and it has been in approved status..but not stamped

But he did not choose to work because of different reasons..

In the meantime I changed my job from company a to company B and my H1b and his H4 is in transfer status..However we have received the receipt number for the same

Now he has to go to India on an emergency visit..Can he use his H4 to go to India and come back?

or Would the consulate question while coming back to get the H1 stamped?He has no chances of getting H1 stamped as he does not have pay stub..

Any answers would be highly appreciated..

What is his status? H4 or H1-Not working? One on H1b has to work and get paid all the time. It is illegal to remain in US on H1b without getting paid. Talk to an attorney.
