Salary on Bench for H1B

As per the rule H1B candidate should be paid all time whether they are on project or not.
My questions is -
If person is working on percentage basis (80-20%) and out of project(bench)then also employer has to pay the employee ?.

Yes, you're correct H1B employee should be paid all the time, period.

Legally H1B employee cannot enter any such deal as 80-20 with any employer.

However, not going into too much controversial details, your payroll has to run every month you're sponsored by your employer, no matter what.

You may get a "vacation" for sometime, but that's about it.
