My wife and I are in H4 and H1B status here respectively (currently in US). Both of our visas have expired, however, i got my first H1B extension last year (an approved I-797).
My wife is planning a month long trip to India. I can not accompany her on this trip. Would she be able to renew her H4 visa stamp with my new approved I-797 notice, however without I having renewed my H1 visa stamp ?
US embassy website lists following as one of the needed docs:
"A good quality photocopy of your spouse's passport -- all 36 pages -- that must include a copy of their valid U.S. visa."
Seems like she won't be able to renew her H4 visa stamp unless i get my H1 renewed or unless we both appear together as my visa stamp has expired and is not a valid US visa.
Please advise.
