    Hi All,

    I am working in L1 visa for company A and I applied for H1 through a consultant and H1 is approved.

    I am planning to travel to India (from Aug 22 to Sep 20).
    Please let me know the following

    1.Please let me know if there could be any complication in Port of Entry?

    2. Can I travel back in my current L1 as H1 period starts only from Oct1?

    3.Any other documents that I need to produce in POE??

    ---- You will need a H1 Visa stamped on Passport as you have travelled out of US. On return to US you must have a I-94 for H1 issued at the POE if you wish to work for the H1 sponsered company.

    ---- If you have a I-94 that has come along with your H1, that becomes invalid when you go out of US (as you have to submit the same at the Port of Departure)

      You have to tell the forum if your H1b approval was a COS or not as that determines what happens upon return. Is your intent to maintain L1? If so, read about "leapfrog" on the forum.

      Read about Efren hernandez memo if your H1b is a COS as even if you enter on L1 on Sep 20, your status will change to H1 on Oct 1st.
